Quickfund/Clear Telecom Scam
Just wanted to let people know to beware of Clear Telecom - Quikfund. They approach small businesses in regard to bundled telephone packages. We have been bitten severely. They tell you that you can obtain free equipment (TV's, laptops etc.) and that the monthly payment of these will be taken off your phone bill. They also get you to sign for 5 years. Then they get you to sign a finance agreement with Quikfund for the equipment. The amount for the equipment isn't taken off your telephone bill and then you are stuck paying off the eqipment plus a overloaded telephone bill. The owner of Clear Telecom is Tony Hakim - he is being taken to court by ACCC. (He also owns Quikfund.)
If you are caught up with clear telecom - ACCC have announced that you can break your contract with Clear Telecom without any legal ramifications.
But then their is still the quikfund finance company that you stil have to pay. ACCC advised me their is a group of people organising to take Quikfund to court. Their email address is Info@TelcoFinanceScams.
Their are alot of business throughout Australia that are now stuck with the finance contract and are unable to get out of it. But with this group of people including myself we will be taking Quikfund to the Federal Court, because under Section 73 of the Trades Practices Act what they are doing is totally illegal.
So please beware I do not want to see anymore people losing thousands of dollars like I have and other small businesses paying huge monthly amounts to Quikfund.
Regards Lynne

I have been caught up with this scam and am trying to get out of this as I am leaving my business due to cancer. The guy who turned up to talk to the people who are taking over the business told me that Quikfund can take my house over as I have signed a 5 year contract, which the person at Quikfund also repeated this on the phone to me. The new people dont want this mess and I dont know what to do as Axiom tell me that I have to keep paying the 550.00 per month and the new people said this is not on. please advise what I can do anyone?

To Thunder, I ask for a payout figure too and they come back to us and said we need to payout $35000.00 for the value about $5000.00, I ask them to give me the cost of each item and they did say that the contract is that you much pay the 550/month so we can not give you the cost of the each item.

Yes we got caught in September 08 & talked to solicitors, telco ombudsman etc but couldn't get any answers. We know we can change Telco's but it's the finance people Quickfund that is the hitch. How come they are not answerable to Dept of Fair Trading for signing up customers to pay $27,720 for equipment that can be bought retail for approx $3,500? As you say, this amount was supposed to come off the telephone bill so that if our calls were $462 per month then we got a credit for this amount - but it didn't eventuate. So glad I saw your web page to-day. Can you keep me informed or tell me what I can do to get rid of these obnoxious people. Regards Jan Black

What a scam . I got caught with stuff I did not want and tried to send it back but they would not accept it. It turns out that the salesman altered the contract as my copy is different to the original. I was told there must have been a problem with the contract paper.I might be green but I'm not a cabbage!.Taipan

It is a big scam. We got caught out by AXis Telecommunications. We did not realise we were signing with another 3rd party for the equipment. We were told that at the end of the contract we could purchase the equipment for $1.10.Axis went bankrupt and we were tod that the finance company EFS does not honour the $1.10 but back of the equipment and that we would have to pay for the equipment. What happens if i cancel my direct debit with EFS and dont return the equipment?

Hi all, I am 3 years into a contract with quickfund through a small business I used to run. I remember the salesperson (scum) who did me over saying “my father raised me not to tell a lie”. Can’t believe I went for that! Those words still wake me at night, as this still impacts on my family and marriage. It’s the personal guarantor issue which worries me. If there is any action I may assist or benefit from I will keep in touch with Greg from 'telco-finance-scams'

We have a contract with Clear Telecom. They sent us a stack of mobile phones and a huge printing machine all of which are still in the boxes. I contacted them and told them we didn't want all this stuff. They told me they are a free gift and we may as well keep them. We begged them to take them back because they are just taking up space and we don't want them. They said we can sell them or do whatever we want but they do not want them back - now I know why.

I guess for me there are 2 stories here. The first is about the people who have been ripped off, and the story should be told and I congratulate 4 Corners for that. The second is why the ACCC is not pursuing Macquarie, Fresh Telecoms and all the companies, and their directors, who no longer providing call credits. I guess the Chairman of the ACCC can't prosecute a company he was once a director of. After the fiasco with his investment in DFO he can't have his blind trust lose anymore money.

Thunder I have been watching the ACCC case for a while and understand the Trade Practices Act very well. From a technical perspective it is very interesting. I can assure you of one thing the ACCC has a top notch legal team. Solicitors are Corrs Chambers Westgarth, check their website, same building as the Premier. Lead barrister, Christine Adamson SC, she is the one of the leading silks in the country. The problem with the case is that the ACCC went after the wrong people. The transcripts show this. Hakim's companies's are honouring their deals with customers. The ACCC acknowledges this. The reason the ACCC is having trouble is because they are chasing him personally, through the charade of the 28 in total but all he did was buy a group of companies with a view to listing them all in the UK. You saw the story, he was in the UK, but his companies are still honoring the deals. Customers are still getting credits. Customers of Forte Connect, Emerald, Truscom and Fresh, to name a few are not. From a legal strategy perspective if the ACCC wanted to it could pursue the counterparties in those deals like Fresh and Macquarie for third line forcing. By using the precedent in ACCC vs. IMB Australia FCA 402, 2002 where Justice Drummond found that where 2 contracts sold as a bundle constitute a single package and thus cannot be third line forcing. What the ACCC could have done is sued Macquarie/Fresh for third line forcing as they are responsible for a bundle where one half was not being fulfilled. Fresh was in liquidation but they can ask the court for leave to proceed againgt Fresh. This would have been easy to get, these things happen all the time. They could have chased Ford to. He would have cut a deal so fast your head would spin. They could have used the ASIC revenue recognition case against NTG to support this view. That came about because NTG used to account for them as 2 unrelated contracts but this changed it to a package. The court would have heard it quickly because of Fresh being in liquidation and Ford's deal and do you know what would have happened? Same as ACCC vs. Bill Express. The finance contracts would have been declared void by the court and customer's can stop paying rent. Justice would have been served. Actually its not too late. The ACCC could actually start this case tomorrow against all the companies that went belly up. If it wants to. If they are really interested in protecting the Australian consumer. For me the ACCC is like a surgeon with 2 patients, 1 has a cut leg, the other has lost the leg in an accident and is bleeding out. What do you do? I would help the one with the lost leg, stop the bleeding and save the patient. Then put a band aid on the other. What does the ACCC do? Let the patient bleed out. That's what's happening here. Small businesses paying rent for equipment AND paying for calls they should be getting credits for and slowly bleeding to death. Graeme Samuel why don't you Macquarie and Fresh Telecoms for third line forcing and have the finance contract declared void because it is one element of a package where the other half is no longer provided.

Thank you Smithers and Thunder for your comments. It can be frustrating for the legal point of view, but what we also have, we,us, as Consumers, Individuals, People, we have the power to speak up and spread this as much as we can, get informed, let also other people know and become more responsible consumers. In the end what goes around comes around. These people can go after all the money they want, but it's "dirty" money if they were aware that those contracts and the whole system was deliberately set up to mislead and let Small Businesses believe it was a good deal (which if done in the proper way in some case it can be) but intentionally omitting that: 1) we were financed (the representative pointed out more than one time the equipment was free, we even got free gifts such as gift vouchers to spend!- and anyway if we were made aware we had to finance the equipment, lots of small businesses have already long business relationships with their own finance/leasing companies for their equipments!) 2) we were binded to the finance contract for 5 years while the reresentative assured us that at any time we could walk away from our contract with no penalty, simply returning the equipment and loosing the call credits.. If that is not misleading and misrepresenting I don't know what it is? Xmas hung-over?

Hi Guys, Yes I am another one who has been and still is being stung by Quickfund, My story is the same as the rest, Word for Word. My business has just gone into "INSOLVENCY" along with myself, This was not caused by Quickfund but I did the correct thing and wrote to them to advise that I would not be able to pay them a thing, there reply was that regardless of my problem I still owe them $40,000 plus for $5,000 worth of goods and they keep saying it is in my interest to make them an offer. It would appear that they do not understand the word INSOLVENCY. We cannot let them win.

Hi All, Yep another who has been stung - I am definatley no lawyer but with the contracts we have all signed with these guys - how many of you acutally saw the terms and conditions or even every page of the contract - and how many of your contracts have page numbers? I have a copy of my contract and there are several pages of terms and conditions that have not been viewed by me. They certainly haven't been signed - I have signed many documents in my time and usually have to initial each page to make them legal.... I didn't see the front or back page and I couldn't have reasonably known that I didn't see all pages as there are no page numbers?? I do realise I am clutching at straws but hey - anything to get out of these criminal contracts. Does anyone have any ideas on this?

I note on Friday the appeal of the ACCC against EFS and CIT was dismissed with the ACCC having to pay the costs of EFS and CIT. This means unless the ACCC appeals to the High Court the financiers have been summarily dismissed from the ACCC proceedings, or in essence found not guilty.

We are wrapped up with this mob as well. I rang Clear Telecoms for a payout and they quoted a ridiculous amount. I rang the telstra businesss call centre and said that they have got people out of Clear Telecoms contracts be referring them to the Telcommunications Ombudsman. I have rung Quikfund and asked them why we are paying up to $60K over 5 years for equipment that wouldn't be worth more than 10K. They refused to give me a breakup of the equipmebnt amount and said that they couldn't do anything. The salesman at the time was very vague when we signed and confused me with all this talk and plans and credit, and he made the Quikfund cost and the Clear Telecoms plan cost out to be the same thing. I am lodging a complaint with the QLd Office of Fair Trading for all the good it will do Any other suggestions anybody?

Wow! Like many of you I also signed a 5 year contract which is costing me about $2,000 per month and I have just over 2 years left. It is most certainly a scam and for a smart business operator, I can't believe I feel for it. I do find it surprising that no lawyer in this country has taken this on. The manner in which we were co-erced to sign into the deal was at the very least misleading. I went to a lawyer but he didn't know where to start.

Quikfund say the sales person from Fusion(now gone under) not their representative and the document not theirs, yet this same person presented their contract and witnessed us signing up.Quikfund also saying they have no copy of the proposal and consequently issued a rental agreement instead of a Lease agreement with a zero residual. This was true for a while then all of a sudden the bills started coming through as high as $1700.00 dollars. We have made a lot of complaints and with no result. We have even told them we want out of the contract and we where told we would have to pay them 40k!!!! Sorry but to get out of this contract for a small business is way over our financial means!!!! On numerous time we have contacted them and like i said before no result!!! Can someone please tell me how I can get out of this situation as it is not what it was ment to be!!! This is what I was sent after a call about the costings of our phone bill??? Hi Mathew, Clear Telecoms is your telephone service provider and what we will bill you for encompasses the billing and provisioning of your telephone services. What you are charged by Clear Telecoms, per month, is based on your call usage from your telephone lines, as well as line rental and associated charges. As your call usage differs each month, therefore the charges you incur will differ every month as well, and Clear Telecoms bills you accordingly after applying a maximum of $720.00 (ex GST) credit to eligible (local, national, international and calls made to mobiles) calls. Because of this your invoice is rarely the same amount each month. Please find attached, your telephone agreement, for your convenience. Kind Regards Moana Turua Customer Service Officer This is how they are trying to get out of ripping honest people off!!!!

I signed a BCC 5 yr lease for a phone system, financed by AIF, and Clear Telecoms gave us $250 per month credits. This has been happening OK, but the lease expires in September, and I now find after 5 yrs of payments I will own nothing, as it went thru as a rental. AIF who I understand are in receivership want $1300 payout figure (down from $3500 after some heated negotiation) so I can take ownership of the system. Yesterday Clear Telecoms rang, full of sympathy and understanding and want to provide more equipment at great rates to help me out. I am curious - are they still being prosecuted? Also, what is the legal situation with the payout & AIF in receievership? Ann

We are yet another victim of this Clear Telecoms/Quikfund Scam. Quikfund have now lodged a default notice on our Credit Reference without any notice to ourselves and now we can't get any credit whatsoever - they have lodged a default notice because they can't go to Court because their scam would be revealed so they are attempting to blackmail us through this way. We have been fighting for the last 6 months to have this Default Notice removed - has anyone else had Quikfund lodge a Default Notice? Initially they wanted $37000 to "settle" this matter then $34,000 then offered $12,000 and then lodged a claim for $17,000 + - we have returned the equipment which is only valued at the high end of the scale of $3000 of which we have already paid $4000 + in payments but never got any subsidised phone service as was promised. Quikfund are enforcing the full terms of the contract and I can't believe they were able to do what they have done

To date we have had 3 demand letters from Quikfund, the last one saying that Quikfund were about to lodge a CRAA default on us. Our lawyer wrote to them stating that the matter would be referred to the ACCC if they did. He also wrote to the CRAA crowd VEDA advising that Quikfund were using them to basically blackmail us in paying them money we didn't owe them and not to aid them in this. To date, we don't have any CRAA defaults logded. We'll see what happens. I am not giving in to these people.

I gave 6 months notice to return our phones to AIF, but they did not issue the invoice for the payout at end of contract as requested. I cancelled the direct debit authority, AIF then sent a default notice for 2 months "arrears" After some discussion a manager agreed to waive the arrears and get the agreed sum invoiced to me within 24hrs. All I got was the agreed sum plus arrears. After several attempts at getting the correct agreed amount I gave up and sent the phones to the address on their letterhead (and in Google) It came back as they had moved. Now they want me to pay the full amount AND send the system back. When I protested they said the system was worth very little to them, but they are chraging me $10.50 a day in arrears. Their latest stance is I owe $1250 in arrears for 90 days, and the original contract was for $314 per month. I bought an identical system to the one they want $1342 for, and it cost me $650. I was prepared to send the system back, but there does not seen to be any advantage. They have a clause that both parties agree to NSW laws and legislation, and I am in QLD. What would you advise?

I have just consulted with a Debt Collection Agency who have had discussions with the Adjudicator from the Tribunal (in Qld is QCAT) on my behalf and said we could definately lodge a claim for the monies paid to Quikfund and any costs in returning the products as well as damages plus an Order to remove all default notices from our Credit Files. As long as it it under $10,000 for approx $450.00 and claims over $10,000 would cost aprox $850. This is great news - could take anything up to 6 months but hey the wait would be very worth it. The QCAT Adjudicator told them they had quite a few of this claims lodged in the last 6 months - shame it has to come to this but these guys don't have a let to stand on. They have made no attempt to take us to Court because they know they would loose. So people my advices is to consult a Debt Collection Agency or Legal Person and get this Claim lodged now

Hi Ralph - we had our Debt Collection Agency (Legal Source from North Lakes) complete and lodge the QCAT Application on our behalf which cost us $455 and was for all the monies we paid and $5000 damages plus an order for the removal of the Default Notice - as this was under $10,000 it was $455 - if it is over $10,000 then the cost would have been approx $800 but well worth the money spent as they do all the form completion and lodgement with the Tribunal. They were told by the Arbitrator that it can take up to 6 months but a short price to pay - success is not guaranteed but certainly in a better position than not doing anything and we are confident - all we want is the Default Notice removed. Let me know if you want further info - good luck

Last year we submitted a claim to the CTTT. We had a first meeting with Quickfund, Clear Telecoms and we refused what they said. We were asking for a refund from Quickfund, Clear Telecoms for misleading and desceptive business. We had another meeting that we could not make and we rang the CTTT to advise we were unable to make the second interview, but unfortunately the message did not reach the right person and the case was dismissed. Two days later we received a letter saying Quickfund was taking us to the local court. Our solicitor advised to submit another claim to the CTTT immediately and we did ($290. each time). We were sent notices of a meeting early this year at the CTTT, we turned up at the meeting and they did not show. Another meeting was scheduled with the CTTT and again this year they did not show up. In the two days we submitted our second claim to the CTTT, Quickfund had submitted their claim to the local court against us. We are now going through the local court in syd and the Registra at the CTTT hinted we should have a good case against Quickfund. Please submit your case to the CTTT or Debt Collector as you could end up in court like us. If we win they will be paying for everything. We have submitted our claim to the QCAT (Qld Tribunal) and we have been advised they are setting up a Task Force due to the number of claims being lodged against these a...holes and hopefully they will make a decision soon in our favour. Recommend to everyone to contact a Debt Collection Agency and get a claim lodged against them straight away

I am claiming back $23,100 in ''Rental'' of my free plasma and phone system after 60 monthly payments of $385. I stopped payments when the 60th payment went through and lodged my claim with VCAT. We had our prehearing last week and Quikfund asked for a phone confrence which was accepted by the tribunal. When the Tribunal attempted to call them they were not contactable. Another date has been set of which they have been ordered to appear in person. If they donot appear this time I will be asking for the Tribunal to make an order in their absense. I've had a gutfull of these scum. Good luck to all. Drapes

In QCAT today with Technology leasing first mediation hearing. Hi Cathy, Quikfund was not able to attend in person so a phone confrence was held. Nothing settled yet. Make sure you give notice in writing (I gave verbal notice) 6 months before the end of your term, this is a major hurdle that you can avoid. Just part of an argument you dont need. Cheers Drapes

Hi everyone, I thought we were the only ones that had this problem. We were approached on Friday 1/6/12 buy a guy from AXSIOM in regards to taking over this account, line rental, equipment etc. I have calculated that over the last 4 years, QUIKFUND have taken $38,000.00 from my account and it doesn't look like I'll get any of that back. I have lodged a complaint with the ACC, I will be going to VCAT shortly to take it further and have tried numerous amounts of time to get hold of someone at QUIKFUND. No one seems to have a good understanding of what exactly it was that my LATE husband signed up to. Can someone please help to shed some light on what they've done? Thanks much appreciated.

Hi all, I too have been scammed and am in the same position as you all. I was contacted by a rep (Could not understand who he represented)a couple of weeks ago asking if they could come and see me regarding the refinancing and update of the equipment I received five years ago - my contract ends in Nov 2012,(up until now I was under the impression I owned after the five years was up). When we signed up 5 years ago I tried to get out of the contract but because the goods had been delivered to me no one was able to help me, we were specifically told that there would be no residual owing after the 5 years and we would own the equipment outright. I have been ringing a 8290-0200 number all day which no one answers. Can anyone point me in the right direction. Thanks.

Oh my god, I cannot believe what I have just been reading. We have had a contract with clear telecoms and previously link solutions for the past 8 years and we have just signed another contract for another 5 years with Choicecom,Flexirent and Clear Telecoms.Today we received notification that choicecom Pty Ltd is in Liquidation. I spoke to them this morning but by 12 noon they are non contactable. I managed to get onto the sales rep that sold us the system and she said she is now out of a job and cant help us.I have called Flexirent whom the finance is with and they have confirmed that we have the finance through them for the phone system. We have only just had the new phones installed and haven't even sent back the old phone system. We are owed $7700 from Choicecom for the payout of the contract to Quikfund. But now I don't know where we stand.I have tried to call Quikfund and the phones are constantly engaged and the website is closed down. I cannot believe we haven't heard anything about these companies being a scam before we have been in business for 65 years and even though these companies are a scam we haven't had any issues with them up until now.We have always received the credits off our phone bills for the rental agreements without any issues. My main concern is that when we signed up for this new system the rep left us without giving us a copy of the agreement we had signed. she then said she would send me a copy of the agreement straight away but we haven't seen it yet even after many phone calls to them. I have faxed them telling them I am going to cancel the direct debit if I don't hear from them but where do we stand?

I have been told by Legal Source that because of the amount of claims lodged with QCAT they are now seriously looking at the whole matter and we can only be hopeful and positive and should know soon which they are going to go - if they say they can't then we will have to withdraw our QCAT Claim (with refund of filing fees) and lodge with the local Magistrates Court. QCAT need to grow the balls and make a ruling to set a precedent so we can all be able to get on with things. Quikfund put a claim on our Credit File and it will only take an Order for it to be removed - the b..stards have been holding us to ransome for too long

Thanks . I was hoping that the recent federal court case technology leasing vs lennmar and the outcome from that that a precedent should be passed down through the local courts and tribunals. We used a Debt Recovery Agent who lodged our claim on our behalf (Legal Source). But ring Quikfund up first and get a response from the idiot on the phone like we did and use that in your claim as it only proves they do not have a legitimate claim otherwise they would be initiating Court action but they are coward and thieves and know they would not have a leg to stand on if they go to Court. MAKE SURE you contact Veda Advantage the Credit Rating people and put them on notice that you have a dispute which is unsettled with Quikfund and not to lodge a default notice until they receive a Judgment Order or similar NOT just the word of a bunch of thieving pric.....s. That's my advice

Hi All, i work for a Telstra Partner and am a ex Telstra account manager. The people on this website have been bitten before and i can already see the vultures circling again to take another bite - no offence Hill I am currently helping a client out of this particular mess that they had signed up through Australian Equipment Rentals. I have been in the industry a very long time and i will tell you right now that the people here that are saying they can help you are trying to get you to end date your contract with clear or quick fund and then purchase their equipment. When you terminate your agreement with Quick Fund they generally own the equipment and you will need to purchase a new phone system - if you want to keep making and receiving calls. People like Hill are just positioning themselves to pickup these new phone systems when they occur. Yes i sell phone systems however i am only on this website researching these a**holes to help my client who yes we are replacing their equipment. Unfortunately guys you will need to terminate your contracts and seek legal representation to help recover your costs, however you will also need to be prepared to replace the equipment that under their contract if rightfully theirs (even though its unfair - they still legally own it). Like i said before i am only here for research however i HATE sharks and these type of people are the scum of the scum and gives a bad name to the industry. If you have any questions i am happy to try and help.

Very True ChrissyH I have already tracked them down to their office location and yet again another parent ABN and company name ( no surprises here ). Paula, funny enough i have also worked in the banking industry for a short time and when you give writing permission to someone to direct debit your account the only way you can stop it is to go to your bank and give them written permission to block them. Once they are blocked the only way they can ever D/D from you account again is if you go to the bank and give them written permission to lift the block. I hope this helps you.

Guys i just remembered that Telstra has a whole of business plan called ALL4BIZ. Depending on your Telco spend with Telstra it gives you a very large Technology Fund which you can also use to pay out early termination charges of your existing supplier to move to Telstra. as a example 5 year contract for a $2500 per month plan is about $25,000 fund The plans start at $1000 per month and move up to $30000 per month. I know it might sound like a sales pitch but it might give some people the necessary cash flow to payout these basta#rds and get back to business. If you are looking at the above i would recommend using a 3 star Telstra partner or a Telstra Business Centre. Yes i do sell this product, however i don't want to appear bias so please refer to the above unless you pacifically need my help. If you want any clarity on what the ALL4Biz offers that people have told you it can and can not do i am happy to confirm for you.

Guys I am not sure how old these comments are so today is the 5/9/2012 .We have also been in conflict with Quikfund over contract which we signed with Axsiom in 2009 which was supposed to be for telephones but promised us this and that and now we have to keep paying altho the Telco Clear let us terminate the contract middle of last year. We stopped our Direct Debit payment to Quikfund and pay via Internet, however if we are 1 day late they charge us $103.00 late payment. We now owe them $1200.00 late payment fees which we are refusing to pay and have received a letter saying they will give us a bad credit by going to Veda. Well you know what, let them! If everybody cancelled their Direct Debits with Quikfund and stopped paying, dont you think they would suffer and maybe go under? From what we have been reading on this page they are fraudulently obtaining thousands of dollars every month. What do you think might happen if everyone stopped paying them. The gutless wonders are too scared to go to court, so maybe we should stand up to them and let them see how it feels.

Hi Paula, I know CBA have a form you can complete and submit to them ( www.commbank.com.au/business/pds/000-470... ) however you will need to check with your bank. I imagine this wouldn't just be CBA. I would also check your original contract as some of these contracts have a auto renew clause for the another full term unless you have given sufficient notice to terminate. I would still suggest pursuing your own independent legal advise and include the legal fees in the claim as going off Thunders last blog they probably wont turn up to defend themselves.
ChrissyH posts
The best way to stop payments is to change your account. The other option is to go to your bank and to cancel the the direct debit authority. Tell them that you have been mislead and they should be able to do it for you at one of there computers. Just be aware that quickscam may use another of their entities to try and keep the direct debits coming out.
Thunder posts
CBA is the only Bank that does it easily, and successfully, and if one slips through they can reverse the transaction. Other Banks don't seem to be that helpful. It is YOUR bank account, and YOUR money, and they are only authorised to deduct funds from YOUR bank account if they have YOUR permission. Some bank employees don't seem to understand this. If the debt is officially "in dispute" it is illegal for them to list you with VEDA. Once listed, the record will remain for 5 years, even after it is settled. Therefore, it is prudent to lodge a Civil Claim in VCAT/CTTT/QCAT before stopping payment. If you have a long time left on your contract, if you continue to pay while the claim is going through, then the hearing will be all about Misleading & Deceptive conduct rather than them arguing "you signed a contract agreeing to pay, yet you stopped paying".

ChrissyH, I think there is a more interesting way this can be handled. There is a group called anonymous who are a bunch of IT Hackers that go around ruining people like this. I remember watching some youtube clips of how they bullied the biggest Cartel in Mexico. Greed is nice if you still have your house, bank accounts and drivers license in your name. I would love to see these guys just wipe all information on this guy. Now the question - How do we notify them?

Hey Telco, i hear they have a twitter account and a face book page. maybe someone can contact through face book and send them various links such as this and other forums, the four corners transcript which is available on line and a few court decisions? It might make for some interesting reading for them! Hey Ripitoff, they have no conscience. It is illegal (misleading and deceptive conduct) however most victims are not even aware and when they are they have to take action and fight it, costing time and money. Most people cant fight it so thats how Quikscam gets away with it.

Hi all, I had been fighting with Quikfund in Vcat, They were trying to claim about $4000 in overdues which they offered to reduce to $1,000 to settle the whole deal once and for all. I rang Hill, I did not tell him who I was and he wouldn't tell me who he worked for so I hung up.... My phone number must have shown up at his end and 10 minutes later he rang me back, knew who I was and what my issue was. He spoke to Barry Kennedy and they dropped any further action, wiped the $1,000 and signed the goods over to me. I'm not saying you should all ring him but thought you should know that I have had the releif that this is over since then. I was still ripped off for 5 years no question but its over now... Good luck to you all. Drapes

Paula look at the first post by Lyne for answers. I doubt it is Quikscam as this forum is only exposing their scams further and alerting alot of people. Personally I would not talk to Hill. No one on this forum has admitted to be helped by Hill as he suggests. I suggest you get legal advice if you are weary of any help offered here.

Thanks for that info Thunder, I will be getting right onto it........yes Paula it is a bit of a worry if Quikfund are secretly putting in moles to find out who is doing what against them! The email address at the top posted by Lynne sdoesnt appear to work as I have sent off an email and got an automated reply saying not a valid email address???? Who knows what is happening there!
Thunder posts
Lynne was a genuine victim and was forced to do a deal for around half of what was owed. That was a fair while ago. I am not sure what email address you are talking about. The partial one she lists is info@telco-finance-scams.com and it works. They eventually find all of the forums and websites talking about them, so it is best to be careful what you say, and don't reveal strategy. Philly, the first line in your last post is good, as it leaves them wondering, and gets up their noses.

Yes we are another person stung by Quickfund Australia Pty Ltd. Sugguestion keep the presure on the ACCC and go to your Federal Memeber and get them to your local Magistrate Court and lodge a claim against them. You must write a letter of demand first stating your claim. Should you be able to win your claim and the fail to attend you maybe able file against them. I also suguest to take it to Today Tonight or the ABC to ensure they are exposed and how many people are affected by there tricks. Look at the website a FACEBOOK page would be suited for Quickfund Australia Pty Ltd. Good Luck everyone there are the scum in business and according to ACCC once the pressure is on he tend to file for Bankruptcy

I'm another naive person who got into trouble, but after waiting so long for the contract to finally ended last year, I tot I've got over that I was scammed, but guess what, after 8 months the contract ended, outof no where, quikfund started taking out money from my account again!!! WTF!! now demanding them to pay back but hey they are in the market to scam people, how much luck to do think I have? I so want to go on current affair to make sure no one else is suffering from what we have gone through! Think of what type of finance company they are, where if none of us sign anything at the begining, we might own a BMW Or Merc by now! shish!!

Hi Philly, also from WA and my boss signed up for all this 5 years ago. The contract is finished in 6 months and I have just found this feed about Quickfund. Boss has gone to the bank and cancelled business bank account to stop the direct debit $550.00 p/m. Thunder, what do you suggest we do now...

I would sugguest that everyone contacts ACCC and keeps on them and perhaps seek advise in relation to there tackets we are seeking legal advice in relation to recovering and there method of black mail. We tried to make a visit to there office and there where not willing to meet. They have a so called manager called Joe Auv.They leave you on hold for some 15 min then hang up on you. I would sugguest everyone stop paying and see what they can achieve it would keep them very busy and perhaps break them. I believe a class action is needed against Quickfund Australia and ACCC, they are there to protect the consumer they seem to have forgotten about small - medium business.

I agree Busbe...I said earlier that if everyone stopped their automatic payments & refused to pay...then surely this would have an adverse reaction on Quikfund...no one paying= no money for them to pay wages etc.....am waiting to see what is the reply to CTTT...I agree also the ACCC should be flooded with complaints about this company and then maybe they will do something!

Telco's comment that the Telstra ALL4BIZ Plan @$2500 per mth for 60 mths will pay out $25000 to get you out of one of these shonky deals is just not correct. The Tech Fund can only be used on Telstra approved products. I have been consulting in the field of telecommunications for the past 10 years and this scam under various names, as they liquidate coys frequently and start up new ones, has been going on for all of that time and more. With a lot of effort and cost it is possible to wear these crooks down and minimise final payouts if they exist. never send the gear back to them, just pack it up "NICELY" and advise them that it is ready for them to collect at the address they originally delivered it to.
Debbieqf posts
Hey Worldly, You Obviously have nothing to do with our company so i advise you not to give out that kind of info as if we do collect our produts they would still have to pay the monthly contract minus the equipment.. Any Further discussions please contact me on (02)95988685 or email me debbie@quikfund.com.au. Thanks :)
Telco posts
Hi Wordly wise. I work for a Telstra Partner and i am a ex Telstra Account Manager. i can tell you for a fact that the Tech fund is also available to payout existing early termination charges from another provider providing these services are being brought back to Telstra however it is not generally advertised. i.e.: if you advised Quikfund to collect their gear and move these services to Telstra under All4Biz and purchased a new system as you had to return the old one then yes you can claim it. If you advised quikfund to collect their gear and moved the lines to Telstra and purchased a non Telstra partnered system then no you can not claim it. You can only claim early termination charges associated with the services being moved to Telstra. I hope this gives a little more clarity.

Hey Debbieqf, Over the years I have had many clients who have had the misfortune to be ripped off by your bunch. We have, on a number of occasions, been able to negotiate a less traumatic outcome for them than the one put to them by your lot when they sort a solution by trying to negotiate directly with the DEVIL6B6J
worldly wise posts
Telco, the charges we are talking about are not Early Termination Charges from another Provider, they are charges from a Finance Company for equipment which could even be a "Free" Plasma TV offered in the original con. This has absolutely nothing legally to do with the telecommunications Provider. I agree that Telstra will cover ETC's to port the Telco services and the Tech Fund can cover the purchase of a new Telstra recommended Phone system. I would also state that we get "nothing for nothing". If you enter into an ALL4BIZ contract that has a $25000 Tech Fund attached to it, be assured that you will be paying the $25000 over the life of the deal. You sign on for a Minimum monthly spend, say $5000. If you actually clock up less than this amoun t in a month, you still pay $5000. If in a particular month you tick up $6000 in calls etc. then you pay $6000 for that month, not $5000. Guess who the overall winner is with ALL4BIZ deals.

Worldly, The main purpose ive been hired from quikfund is to deal with people like you, obviously your a Telco dealer who got the clients messed up to begin with, like i said contact me you have my details :)

Debbie, Lets not forget here that your CEO was the previous director of many of these Telco dealers ripping off small business owners that i am sure has been quite profitable for him. He is no longer allowed to practise in Telco but he is in finance which is quite convenient. These business tactics that was used is absolutely disgusting and your clients don't want anything to do with your company - nothing personal. If you do actually want to help these small business owners from these terrible scams that Quikfund have been associated with you will end date any contract that has served its full term without penalty and not try automatically renew contracts or charge people overcharged ETC's to end date their contracts. Unless you are going to be fair and reasonable you have no place here. If you are going to be fair and reasonable i suggest you point that out quickly and i am sure that people will blog this was the case after the fact. But if not then you are probably wasting your time here. In regards of your last post to Worldly, if he is or if he isnt is irrelevant - Your company is the one upholding these ridiculous contracts so make sure your own backyard is clean before you start looking into someone else's.

When you sign for a contract usually means you have read the terms and conditions and know exactly what you have signed up for so how is it a scam when clearly you know what you have put yourself into, anyhow my details are there for all to contact me on so please do not hesitate as it is my job to do so.. Hi all, i rang the number and a Delilah answered the phone. I have only known one Delilah and i have only read about her and what i read was that she couldn't be trusted! She betrayed for money! How appropiate! If we were all to read the contracts and the fine print it would take over an hour, try it and time it for your self. the sales ppl are there for a quick sale ...sign here..and here...and here etc. most of us did not even get a copy of the contract so that we could read it later and be given a chance to cancel within the cooling off period. so No DELILAH we did NOT know what we signed up for. Are YOU listening? If so and you are genuine in your help FIX IT.
Telco posts
Debbie, The reason why it was a scam was how it was positioned to your clients. The people who signed up for the contract are yes technically liable which is the only reason you have manage to win some of the court battles however because the way your sales people or the dealers have positioned it was free plasma highlighted within the opening pages however in the fine print it was clearly not. - This is deceptive and also fraudulent which is why Tony Harkim is also not allowed to own a Telco company anymore so don't pretend like your company or the dealer agents did not try to hide these details because it is very clear that it was purposely deceptive. I do agree that some onus needs to be placed on the client for not reading the fine print and or allowing someone to walk out of their premises without a copy of what they had signed for.however a really good salesman and a naive person can easily be tricked ( no disrespect to anyone here ). i.e.: "rather than take a photo copy of the contracts i will scan and upload them for you once it has been approved". Yes this was a silly thing to allow or naive or moment of brain fart or whatever you want to call it however these proposals and contracts are completely misleading and clearly not fair. Ask yourself this debbie - Do you honestly believe that the services provided to these clients is fair and just and it forms a good business relationship. If you answered Yes then do something about it - If you answered no then you may as well quit because your attitude is clearly to take advantage of people and the last thing these guys need is someone else from Quikfund claiming they are going to help them. I understand that you might be new to the role - I suggest you have a very good look at the history of Quikfund and its owners and previous dealings and ask yourself do you really want to work for someone like this? Watching small business owners struggle and declare bankruptcy because they can not get out of Quikfund contracts - Is this something you want weighing on your mind?

Any company that adds things to a contract after the client has signed it and made the unfortunate mistake of not insisting on a copy of the document at the time of signing, is only going to go down one path and that is to rip off the client for as much as they possibly can. Other aspects of their contract confirm this, like having to give 6 months notice in writing prior to the end date of the contract, otherwise it will run for an additional 6 months from the time notice is given. Everything they do has a very strong smell about it.
Busbe posts
Ask them to collect the items and ignore them as the business is closed. How did they contact and why after two years? Seek advice and report them once again to ACCC. The are shonks. I have ordered signs for our vehicles to warn the public of the company and the deals they do, Try a history search on the company and Directors of Quickfund interesting reading.

QFSUX12, a couple of thoughts. If the contract was with the business that has closed, was that a limited liability company,if so tell these fraudsters to sue the company that no longer exists...a bit of their own medicine. The second option is to just ignore them if it took 2 years for them to get back to you. Finally, it would be wise to seek legal advice as well.Good luck dont give in to them.
worldly wise posts
QFSUX12, legally, dissolving the partnership does not remove responsibility for debts incurred by the partnership. Liability rests severally and individually. That means the debtor can pursue the partners together or individually, if one individual has no assets after dissolution of the partnership then the debt can be totally enforced on another ex partner who has enough assets to cover the original debt.Definitely seek legal advice ASAP and remember dont give in to thes crooks.

I have not long ago given the required six months notice of termination & received an acknowledgrement. I have the usual $1.10 option to buy out a 50" plasma TV & but the contract says the tv & office phone system are to be returned. Quikfund seems willing to put a purchase price on the items & i am interested to know if anyone has been able to negotiate a reasonable deal. I my view a 50" five year old plasma tv without any warranty isn't worth much & the same phone system two yeras old with warranty can be bought for around $350. Any feed back ?? Paula my contract only requires the goods to be returned in working order it says nothing about you paying for a techo to come out & check it out I'm leaning very heavily towards telstra to replace the phone system if quikfunds offer is unreasonable

Whatever state you are in, it will be interstate to you. There have been cases of equipment going back and the address given is vacant. Another received a letter demanding payment some 2 years after the goods were returned, then they had to try to find the old con note and get POD. File a civil claim in the Fair Trading Tribunal - it is cheap, brings the matter to an end, and you may even get a refund!!!

Well we submitted our case to the CTTT over 12 months ago. Many delays later but today the last day of the High Court, yes it went to the high court and we were offering not to pay the pay out figure of $26,000 and we would return the equipment. Well WE WON WE WON WE WON and we cannot believe it. they have to pay us back the money that should not of been charged in the first place plus legal fees. Yippeeee. kj posts
We submitted our claim to the CTTT (cost around $280) and we stuck to our guns by saying that their contract was misleading and deceptive. At the hearings we said NO to paying out the pay out money $26 as we have already paid this amount and more and they were misleading and deceptive, but we offered to return the equipment. (phone system, 6 handsets, photocopier big one, plasma tv). They said no and we had to obtain a lawyer as it went to the High Court. The decision today was they had to pay us back the money we should not have paid ($16,800) and we do not have to return the equipment. They also have to pay us back all the legal fees. HA HA to them, I cannot believe it but it has taken 12 months to get here but it has been worth it even with all the worry that we had to pay them back. My hubby and I lost our business over this and it is a little bit of sunshine at the end of the tunnel finally. Good luck with it all. Submit your claim to the CTTT you can do this online.

hey quickscammer. I do not go for the name much but anyways Our case number is 2011/374908. Their contract was misleading and deceptive, because they offered us free equipment with a payout figure of $1.00 at the end of the contract period of 5 years and we could have the equipment but this was not the case because they were asking for it back and to pay for a payout figure of $26K. It was in the local court sorry not the high court silly me.

Paula did you get anywhere with Mike Hill :) let me guess he is also wanted money and ask for high amount of payout figure ?? if he is dont bother and go make a claim to the CTTT like most of us will be. You can also put the refence number as KJ already mention for you is 2011/374908 this is her case number and there is also another one. Cheers 27/12/12

Hi Paula, yes I was helped with my letter but it was not mike hill. I do not like to tell the person because they might not want me to. You need to sit down and relax and think about what was offered to you at the time of contract and what you want you want now. Did they state to you to pay $1.00 at the end of the contract and you would own the equipment. And now they are telling you a payout figure of whatever and return the equipment. Then this is misleading and disceptive practice. You need to have your paperwork in order, then submit it to the CTTT on-line cost around $300. You will probably end up in court if you are not successful with the CTTT hearings as we did (lawyer $2500) but we will get all that back if you win as we did. It is a bit of a process and they do not turn up to hearings at the CTTT which worked also in our favour. It took over 12 months from our first submission to CTTT. Submit your letter ASAP so they do not send you to court first. Good luck with it I wish I could help further.

I have never heard from Quickfund or the telco since.....now I have a giant bill!! Any help would be appreciated. Thanks

HILL-It continues to amaze me how you can continue to be involved with Business – After lengthy discussions with your own staff it seems to be common knowledge that Quikfund is owned by Tony hakim, Mik Hill is Mik Hakim and that you continue to lie and deceive customers as you have for more than 10 years. You only have to read what all the other businesses have reported about you on this page, do you honestly think we are that Naive? I was approached by one of your businesses Mik Hill/Hakim, Telecom Connect and thank god we went in another direction and hopefully this means we will never have to deal with you or your Cronies again.

Just to let people know, TELECOM CONNECT is involved with mick hakim. The owner of telecom connect is Kammy Shankar and she started working under mick in sales. Now she owns TC and mick works with her in the same office! Mick also sells leads to Kammy from his clear telecoms/ quick fund customers which is how TC knows who to call. Kammy then does the exact same thing to customers. Do you know how I know this? I used to work for TC until I found out I was signing up customers to a DODGY company affiliated with the hakim family. Telecom connect is scum and if you can get out of your contracts with any of these companies, I recommend this!
Quickscammer posts
Pity this scum still can operate under someone else name for quick money. Thanks for the info spread the word and soon they will be out of business.

'Mick' otherwise known as Mick Hill, is the Client Service Manager at Quikfund, as shown in the emails he has sent to my business via Quikfund. VCAT recently ruled against them in Sherberry vs Quikfund http://www.austlii.edu.au/cgi-bin/sinodi... I hope everyone goes to tribunals against this dodgy company so future cases will be resolved even faster! 15/1/13
Thetruth1234 posts
Mick hill is the name he goes by now as his real name mick hakim is known, as is his brother tony hakim. Tony is the leader and gives mick company's to run into the ground, like quikfund. And Kammy the owner (or "general manager" as telecom connect is in her husbands name) said mick has just been given another company so he is out there again but we were not told the name unfortunately. M2 clear could be it but not sure. Mick owns quikfund, but I don't think he can put his title as the owner. Tony hakim puts all his companies in brothers and cousins names, it's all in their family. Telecom connect is apart of all of this, and I feel horrible knowing I've been apart of it for a while. I've started calling my customers to try and help them out of their contracts but I don't know what else I can do to help.

G'day all - new to the site. discovered this site after spending 3 hours trying to get somewhere with Quikfund - after searching the internet and ACCC, ASIC and NSW Fair Trading i have discovered we are one of many small businesses that have been scammed by these aholes. we asked for a payout on our contract as we were sick of paying $550 / mth only to be told that we had given notice 11 days late (should have been 10 Jan 2013 but gave notice 21 jan - contract finishes 10 July). i have lodged a complaint with NSW Fair Trading and will let you know how it goes. FYI - we did not realise that the contract had a 6 months notice period - in our view we signed a contract that finished 10 July 2013 (60 mths contract) and at the end of it we would own the equipment. as per everyone above we now know that this is simply a scam. clear telecoms were the other party to the deal - that is who we thought we signed up with and quikfund were the financiers for Clear telecoms - we were told we were paying it off in exchange for call credits on our phone bill - effectively the equipment was "free". today is 23/1/13

Further to my post some weeks ago, my husband received an "over due" notice of payment for the contract I tried to get out of some 2 years ago (and have not heard from Quikfund for 2 years since stopping the direct debit)as he was "guarantor" on the contract. He NEVER signed the contract and has nothing to do with my business, so where did they get his information from? I emailed them to say he was nothing to do with the contract (as well as telling them I was not paying their bill) and they apologised and said they would update their data and remove his name. This was back on Jan 11. Yesterday he received another "over due" notice!! I am not and will not make another payment to Quikfund, they are scammers and should be made to cease all business!!

Whatever you do, don't go with telecom connect or nexgen or gen7 if any of you guys ever sign with a telco again. Telair is the company I would recommend or Telstra (Telstra is a rip off but they are a well known and you know they won't be dodgy at the end of the day). And remember, sales people are very nice, for a reason. They've made a living making people think they are lovely people but most know what's going on. Be very weary of telcos!!!

kidderco, don't make the mistake of doing nothing, otherwise, when the debt blows out to more than $10k they will take you to Court and trash your credit rating, which will be expensive. Send an email to info@telco-finance-scams.com After I changed back to Telstra, they put me on a business plan and you know something??? My phone bills were cheaper than the scammers, and cheaper than my prior Telstra bills. Every day there seems to be a new Telco name pop up and close down, so be careful!!!
kidderco posts
thank you Thunder. Having read many of these posts how do you know who to trust though? I haven't used Clear Telecoms since I stopped my direct debit in September 2010. I haven't heard from Quikfund until January 11 2013!! I am a Telstra customer through and through because I don't trust anyone else. With all of the cases against Quikfund how can they still operate....it's insane.

I got out of clear telecom but still hanging with the Quickfund. The contract is still to go for another 2 years. This is for a commander system we entered into a contract. Paying 297 per month. Tell me how to get out of this?
Thunder posts
You have to be careful what you say on here, as they are reading this as well. Therefore, if we tell you how to get out of it on here, they become aware, and close loop holes. They have done thousands of these cases. Read above, my website and email address are both up there. Remember, they will bully you to pay, threaten you with VEDA. They don't care about you - it is all about the money. Some victims have been awarded full refunds and ownership of the free equipment. Personally, I cannot see why they don't honour these contracts and give everyone their free equipment (as promised). Most of this equipment is outdated, broken and worthless.

Just got a letter from these as well Jan 2013 about the ridiculous amount we owe as well.We stopped payment a year ago after We changed telco companies, and asked them to pick up their Tv's and never heard back!Seems like they have hit hundreds of small businesses.I called them to say come get the TV'S or we would package them up and send them back and they starting calling us again, seems like we could have a fresh new story to tell. Will act on a few of above suggestions
